Notice of Privacy Practices

Effective August 2026

This notice describes how medical and mental health information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Our commitment

3:16 Behavioral Health & Wellness, PLLC is required by law to maintain the privacy of your protected health information (PHI), to provide you with this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect.

How we may use and disclose your information

  • Treatment — to provide, coordinate, or manage your counseling care, including consultation with other providers involved in your care.
  • Payment — to bill and collect payment from you, your insurer, or another responsible party.
  • Health care operations — for quality review, supervision, training, and administration of the practice.
  • As required by law — including reporting suspected abuse or neglect of a child, elderly person, or person with a disability; responding to a valid court order; and other disclosures mandated by Texas, New Mexico, or federal law.
  • To prevent serious harm — when disclosure is necessary to prevent or lessen a serious and imminent threat to the health or safety of you or another person.

Other uses and disclosures — including most uses of psychotherapy notes, marketing, and any sale of information — will be made only with your written authorization. You may revoke that authorization in writing at any time, except to the extent we have already acted on it.

Your rights

  • Inspect and receive a copy of your record, with limited exceptions.
  • Request an amendment to information you believe is incorrect or incomplete.
  • Request confidential communication by a specific method or at a specific address.
  • Request restrictions on certain uses and disclosures; we must honor a request to withhold information from your health plan for services you paid for in full out of pocket.
  • Receive an accounting of certain disclosures we have made.
  • Receive a paper copy of this notice at any time.
  • File a complaint with the practice or with the U.S. Department of Health & Human Services Office for Civil Rights. You will not be retaliated against for filing a complaint.

We reserve the right to change this notice and to make the revised notice effective for information we already have as well as information we receive in the future. The current notice is always posted on this website and available at the office.
